The Kentucky Environmental and Public Protection Cabinet conducted a public hearing on Jan. 15, 2008, at 10 a.m. (EST) in the conference room of the Division for Air Quality, 803 Schenkel Lane, Frankfort, KY. This hearing was held to receive comments on a revision to the Kentucky State Implementation Plan. This revision provided a second 10-year maintenance plan for the following eight-hour ozone attainment/one-hour ozone maintenance areas:

The Kentucky Environmental and Public Protection Cabinet conducted a public hearing on Aug. 6, 2007, at 10 a.m. (EDT) in the conference room of the Division for Air Quality, 803 Schenkel Lane, Frankfort, Ky. This hearing was held to receive comments on a source specific revision to the Kentucky State Implementation Plan (SIP) for the Tennessee Valley Authority (TVA) Paradise facility, located in Muhlenberg County.

This is the final submittal for the federally mandated Clean Air Interstate Rule (CAIR) and the associated revisions to the Kentucky State Implementation Plan.

This hearing was held to receive comments on three proposed new regulations to address the federally mandated Clean Air Interstate Rule (CAIR) and the associated revisions to the Kentucky State Implementation Plan.

The Kentucky Environmental and Public Protection Cabinet conducted a public hearing on July 20, 2006, at 10 a.m. (EDT) in the conference room of the FIVCO Area Development District, 3000 Louisa Street, Catlettsburg, Ky. This hearing was held to receive comments on a proposed State Implementation Plan (SIP) revision to redesignate the Kentucky portion of the Huntington-Ashland, West Virginia-Kentucky ozone nonattainment area to attainment for the eight-hour ozone National Ambient Air Quality Standard. This revision, when approved by U.S. EPA, will redesignate Boyd County to attainment, and document that the ambient monitoring data for eight-hour ozone indicates attainment of the standard. The proposal also includes a plan for the area to maintain compliance with the standard and implement contingency measures in case subsequent violations of the standard occur.

The Kentucky Environmental and Public Protection Cabinet and the Louisville Metro Air Pollution Control District conducted a public hearing on July 19, 2006, at 10 a.m. (EDT) in the board room of the Louisville Metro Air Pollution Control District, 850 Barret Avenue, Louisville, Ky. This hearing was held to receive comments on a proposed State Implementation Plan (SIP) revision to redesignate the Kentucky portion of the Louisville, Kentucky-Indiana ozone nonattainment area to attainment for the eight-hour ozone National Ambient Air Quality Standard. This revision, when approved by U.S. EPA, will redesignate Bullitt, Oldham and Jefferson counties to attainment, and document that the ambient monitoring data for eight-hour ozone indicates attainment of the standard. The proposal also includes a plan for the area to maintain compliance with the standard and implement contingency measures in case subsequent violations of the standard occur.

March 24, 2006, NOx SIP Call SIP Revision
On March 24, 2006, the Kentucky Environmental and Public Protection Cabinet submitted to the U.S. Environmental Protection Agency (EPA) a revision to the State Implementation Plan (SIP) that addresses the following NOx SIP Call issues: (1) adoption of a new regulation to address EPA’s Phase II NOx SIP Call final rule published in the April 21, 2004, Federal Register concerning stationary internal combustion engines (ICE); (2) amendment of an existing regulation to address EPA’s position related in a Jan. 23, 2004, letter that it was optional for fluidized catalytic cracking units (FCCU) CO boilers to be subject to the NOx SIP Call; and (3) an update to SIP language to reflect the Dec. 18, 2002, amendment to 401 KAR 51:160 that provides for the selling of a percentage of EGU NOx allocations by the commonwealth.
In order to comply with EPA’s Phase II NOx SIP call requirements, the cabinet has adopted 401 KAR 51:150, NOx requirements for stationary internal combustion engines, to require an 82-percent NOx emission reduction for large stationary ICEs per EPA’s April 21, 2004, final rule. The cabinet has also amended 401 KAR 51:160, NOx requirements for large utility and industrial boilers, to exempt FCCU CO boilers from being subject to the NOx SIP Call per EPA’s Jan. 23, 2004, position.

The Environmental and Public Protection Cabinet conducted a public hearing on Jan. 26, 2005, at 6 p.m. (ET) in the conference room of the Division for Air Quality, 803 Schenkel Lane, Frankfort, Ky. This hearing was held to receive comments on a proposed State Implementation Plan (SIP) revision for the southern portion of Boyd County to become redesignated to attainment for sulfur dioxide under the National Ambient Air Quality Standards (NAAQS). This revision, when approved by U.S. EPA, will redesignate Boyd County's nonattainment portion to attainment and includes documentation that both the ambient monitoring data and the modeling data for sulfur dioxide indicate attainment of the NAAQS. The revision involves only the southern portion of Boyd County.

States were required by U.S. EPA to recommend designations for the 8-hour ozone standard by July 15, 2003. Kentucky’s proposed designations were signed by Governor Patton and submitted on July 14, 2003.

The Kentucky Natural Resources and Environmental Protection Cabinet (now the Environmental and Public Protection Cabinet) submitted to the U.S. Environmental Protection Agency (EPA) a formal SIP revision that addressed the NOx SIP Call budget demonstration and the implementing regulations listed below.
