Regulation Development Section
The Regulation Development Section of the Program Planning Branch is responsible for drafting and promulgating air pollution control regulations.
How do we know a regulation is needed?
The need for a new regulation or amendment to an existing regulation is first identified. This could result from any of the following:
- An action mandated under an executive order issued by the governor of the commonwealth of Kentucky.
- An action identified by the cabinet as necessary to protect human health and the environment of the citizens of the commonwealth of Kentucky.
- A State Implementation Plan (SIP) revision or SIP Call from the U.S. EPA.
- A revision to the federal New Source Review (NSR) or Prevention of Significant Deterioration (PSD) programs.
- Promulgation of, or amendment to, a federal New Source Performance Standard (NSPS) regulation in 40 CFR Part 60 under Section 7411 of the Clean Air Act. http://www.access.gpo.gov/nara/cfr/waisidx_00/40cfr60_00.html
- Promulgation of, or amendment to, a federal National Emission Standard for Hazardous Air Pollutants (NESHAP) regulation in 40 CFR Parts 61 or 63 under Section 7412 of the Clean Air Act. http://www.access.gpo.gov/nara/cfr/waisidx_00/40cfr61_00.html

- A revision needed to maintain approval of Kentucky’s Title V permitting program.
- A revision needed to maintain approval of Kentucky's Acid Rain program.
- A revision to the federal Asbestos Program under 40 CFR 61, Subpart M; the Toxic Substance Control Act (TSCA); or the Asbestos Hazard Emergency Response Act (AHERA).
- Other actions required under the Clean Air Act. http://www.epa.gov/air/caa/
- A revision needed to clarify or correct a deficiency in an existing regulation or program.
- Amendments to existing regulations necessitated by revisions to KRS Chapter 13A.
- General housekeeping amendments to update a regulation or correct errors.
Who decides that a new or amended regulation is needed?
- Anyone may identify the need for a new or amended regulation: the governor, cabinet staff, members of the regulated community, the general public, the U.S. EPA, LRC staff, the General Assembly, etc.
- The most usual identifiers of needed regulatory activity are the U.S. EPA, division’s branch managers and the staff of the division’s Program Planning and Administration Branch.
- After the need is identified, all requests for the promulgation of new or amended regulations filter down to the Regulation Development Section. While a wide variety of individuals become involved in deciding the content of a regulation, it is the responsibility of this section to compile all input into a working regulation and then guide it through the promulgation process mandated under cabinet policy and KRS Chapter 13A.
